February 7, 2011 - Charges have been filed against a suspect arrested in the fatal shooting of a man and wounding of another at 1317 Winter Street about 2:30 a.m. on Saturday (Feb. 5).

The suspect, Eugene Ybarra (H/m, DOB: 9-3-75), is charged with capital murder in the 262nd State District Court. A photo of suspect Ibarra is attached to this news release.

The deceased victim, Samuel Mireles, 29, of Houston, suffered a gunshot wound to the head and was pronounced dead at the scene. A second male, Israel Herrera, 29, suffered a gunshot wound to the head and was transported to Ben Taub General Hospital in critical condition.

HPD Homicide Division Sergeant C. Elliott and Senior Police Officer M. Stahlin reported:

A male suspect, known to Mr. Mireles and Mr. Herrera, was allowed into the residence at the above location. At some point, the suspect pulled a pistol, demanded money and then began shooting. Mireles and Herrera were both struck. The suspect immediately fled the scene.

Further investigation and witness statements identified Ybarra as the suspect in this case and earlier this morning he was taken into custody without incident.
