Suspect Charged Following Incident at 9803 Club Creek October 5 , 2009 - Charges have been filed against an armed suspect wounded by a Houston police officer at 9803 Club Creek about 4:45 p.m. on September 28. The suspect, Pedro Acuna (H/m, DOB: 10-21-87) is charged with aggravated robbery with a deadly weapon in the 228th State District Court. He suffered a gunshot wound and was transported to Ben Taub General Hospital where he is being treated. Senior Police Officer G. E. Polk, who discharged his duty weapon, was not injured in this incident. Officer Polk is assigned to the Westside Patrol Division and was sworn in as an officer in November 1996. HPD Homicide Division Sergeant W. Bush and Officer C. Sturdivant reported: Patrol officers responded to a robbery-with-weapons call at 9803 Club Creek and were flagged down by a male who said he had been carjacked by Acuna and believed he was in an apartment complex at 9803 Club Creek. Officer Polk confronted Acuna, who was still in the victim’s car, in the apartment complex parking lot. Acuna ignored repeated orders to give himself up and when he attempted to pull a loaded handgun from his waistband, Officer Polk discharged his duty weapon and struck Acuna in the abdomen. Acuna was taken into custody and then to the hospital. As is customary in HPD officer-involved shootings within the city limits, this case is being investigated by the HPD Homicide and Internal Affairs Divisions, as well as the Harris County District Attorney’s Office.
