Aggravated Assault of HPD Officer at 44 Farrell

December 18, 2009 - Charges are pending against a suspect who shot a Houston police officer at 44 Farrell about 8:45 p.m. on Thursday (Dec. 17).

The suspect, Jose Angel Montemayor (H/m, DOB: 9-9-74) , faces charges of aggravated assault of a police officer, felony possession of marijuana and possession of a controlled substance.

The officer, J. R. Dunn, of the Narcotics Division, was not injured by a bullet that struck his bullet-proof vest.

Sergeant H. R. Torres, who discharged his duty weapon, was not injured in this incident. Sergeant Torres, assigned to the North Patrol Division, was sworn in as an officer in March 1988.

HPD Homicide Division Sergeant B. Williams and Officer M. Khan reported:

HPD Narcotics Division officers obtained a search warrant for a residence at 44 Farrell. As the officers approached the residence, they announced themselves as police officers with a warrant. As the officers struck the door of the residence with a battering ram, several shots were fired at them from inside. Officer Dunn was struck in the chest, but his vest absorbed the round. Sergeant Torres, believing his safety and the safety of his fellow officers was in danger, fired at least once towards the front door of the residence but did not strike anyone. The officers retreated and established communication with the persons inside the residence. A short time later, Montemayor and five other individuals exited the house and were taken into custody. Montemayor admitted to his involvement in the incident and the remaining five people were questioned and released at the scene.

As is customary in HPD officer-involved shootings in the city limits, this case will be investigated by the HPD Homicide and Internal Affairs Divisions.
