Incident at 6425 Westheimer

August 24, 2005 -- The fatal shooting of a woman at 6425 Westheimer on Saturday, August 6, 2005 about 3 a.m. will be referred to a Harris County grand jury.

Tracy Lamar Higginbotham, 35, suffered a gunshot wound to the left eye and was pronounced dead at the scene.

The shooter, Marcus Omar Winton, (bm, 4-15-81), was questioned by investigators and released without charges.

HPD Homicide Division Officers D. S. Vasquez Jr. and M. Sosa reported:

A witness observed Higginbotham lying on the parking lot pavement. He got out of his vehicle to check on Higginbotham's condition and he noticed that she was bleeding from the head and not moving. The witness called 911 for police and an ambulance.

Investigators learned that Ms. Higginbotham had an argument and a physical confrontation with Marcus Winton in the parking lot prior to being shot. After shooting Higginbotham, Winton fled the scene in a blue Chevrolet Impala.
